10 pro-abortion ballot states are on the ballot in the 2024 election

Voters in 10 states, including battleground states Arizona and Nevada, will weigh the proposals abortion amendments on their ballots this year, decide whether or not to protect abortion rights in their state constitutions.

The US Supreme Court’s 2022 Dobbs decision overturned Roe v. Wade and exacerbated the mix of abortion laws. But in the years since, voters in several states have widely approved ballot measures for expands and secures abortion rights while cancellation of proposals to restrict access to abortion. Political candidates have too considered abortion rights a winning issue with constituents.

This year, with 10 states set to vote on pro-abortion ballot measures and plenty of high-stakes races, Democrats are hoping the popularity abortion rights will translate into gains for politics – and for their party. Meanwhile, Republicans in several states have he tried hard to reject the proposals before voters can get to the polls.

This is where voters will decide on abortion rights on Election Day.

Arizona

A citizen-initiated ballot measure in Arizona it would protect the right to abortion and prevent the state from restricting access to the procedure until about 24 weeks, or when a fetus can survive outside the womb. The proposal is likely to pass; a New York Times/Siena College Poll of September found that 58 percent of likely voters said that supports the amendment. Passage of the measure would repeal the state’s current ban on abortions after 15 weeks, with no exceptions for rape or incest.

COLORADO

In Colorado, one of the few states that does not restrict abortion for adults, voters will vote on a measure to enshrine abortion protections in the state constitution. The measure would also lift the ban on using public funds for abortion services, possibly allowing Medicaid or government employee health insurance plans to pay for the procedure.

Montana voters will decide whether to uphold a 1999 state Supreme Court ruling that protected the right to abortion until fetal viability. State courts have blocked several anti-abortion bills in the past, citing the 1999 ruling, and abortion rights advocates hope to enshrine the right in the state constitution.

Nevada

Abortion in Nevada is already legal up to six months, but voters in the battleground state will vote on whether to do it enshrine this standard in the state constitution. If passed, Nevadans would have to approve the ballot question again in 2026 to formally amend the constitution.

Florida

Despite the many challenges from Governor Ron DeSantis and other Republican state officials, Florida’s Amendment 4 is set to appear on the ballot in the Sunshine State. Residents will vote on whether to protect abortion access until the fetus is viable or around 24 weeks. If passed, the amendment effectively repeals six-week state ban. DeSantis warned that passage of Amendment 4 would represent “the end of the pro-life movement.”

Nebraska

Nebraska is the only state with competing abortion amendment proposals on the ballot this year. One measure would protect abortion until fetal viability or “when necessary to protect the life or health of the pregnant patient.” The other would essentially codify the state’s current ban into its constitution, banning the procedure after the first trimester, with exceptions for medical emergencies, rape or incest.

If voters approve both measures, whichever gets the most votes will be the one to enter the state constitution, according to The Associated Press.

Maryland

Maryland, like Colorado, imposes no restrictions on abortion throughout pregnancy. With one measure of the right to abortion on the ballot this year, voters will decide whether to enshrine the right to reproductive freedom in their state constitution.

Missouri

An amendment to permit the State of Missouri to regulates abortion only after fetal viability“except to protect the life or health of the woman,” will be on the ballot. Adoption of the measure would be effective repeals the state’s almost total ban on abortion.

new york

New Yorkers will vote for a measure expands the state’s equal rights amendment to add protected classes to include “task, task results, and reproductive health and autonomy,” effectively preserving the right to a abortion in the state.

Despite Democratic dominance in New York and the state’s historically liberal reputation, the measure is not sure it will pass. The ballot proposal does not include plain language to explain that it would protect abortion and LGBTQ rights. Democrats pushed to includes such language, but a judge declined to compel the state Board of Elections to do so. New York Republicans, who have gained ground in the last electionthey have used the technical language of the measure for framed it inaccurately as termination of parental rights and expanding trans rights for minors.

South Dakota

South Dakota is set to vote a proposal which would allow abortion throughout the first trimester of pregnancy, allow “regulation” by the state that is “reasonably related” to the health of a pregnant person in the second trimester, and allow “regulation or prohibition” in the third trimester, with exceptions .
