Are the Menendez brothers out of jail?

Lyle and Erik they have not been officially released from prison nor have they received parole. However, prosecutor George Gascón announced on October 24, 2024 his recommendation to the court “to eliminate life without the possibility of parole and they will be convicted of murder”, indicating that the brothers would be eligible for parole if a resentment is accepted.

“I think they paid their debt to society,” Gascón said of Lyle and Erik, who proved their rehabilitation during their time in prison, “creating groups that deal with how to address untreated trauma, creating groups that to deal with other inmates who have physical disabilities and may be treated differently,” the prosecutor emphasized.

“Even in one case, Lyle (was) negotiating for other inmates about the conditions they live in,” Gascón admitted, while clarifying that “there is no excuse for murder.”

The DA also noted the outpouring of support from the public after Monsters: The Story of Lyle and Erik Menendez premiered, and he admitted new evidence supporting the brother’s claims of sexual abuse. In light of this, Gascón explained that although Lyle and Erik’s choice to kill their parents was wrong, they grew up.

“All this was done by two young people,” the prosecutor added, referring to when Lyle and Erik they were 21 and 18 years oldrespectively, when they fatally shot their mother and father. “They are not as young now. They had no hope of ever getting out of prison. … I think the brothers were subjected to a tremendous amount of domestic dysfunction and molestation.”
