Delhi court refuses to quash surveillance circular against infrastructure developer ATS – ThePrint –

New Delhi, Oct 14 (PTI) A Delhi court has refused to quash a lookout circular (LOC) against real estate firm ATS Infrastructure Limited developer Geetamber Anand and his wife Poonam Anand , in connection with multiple FIRs filed against the builder.

The FIRs include those filed by the Economic Offense Wing (EOW) of the Delhi Police for allegedly defrauding home buyers, and another money laundering case filed by the Enforcement Directorate.

Judicial Magistrate Yashdeep Chahal, in an order passed on September 13, said the accused had joined the investigation as and when required, but, “the LOC appeared to be a safeguard to ensure that the judicial process does not be frustrated in any way.”

“Even if applicants are required to obtain prior permission from the court before traveling abroad, the accused could always travel without obtaining such permission and there would be no way for the court to enforce a condition of that nature,” he said.

“As for the applicant’s personal liberty, suffice it to say that reasonable restrictions on the right to life and personal liberty could always be imposed in accordance with the procedure provided by law,” said the judge

“In view of the above discussion, I do not see sufficient grounds to direct the withdrawal or cancellation of the LOC,” he added.

The judge, however, said it was not proper for the concerned authorities to detain an accused while traveling abroad without communicating the reasons for stopping the travel.

It is a basic right of the accused to know the reasons for the stoppage of his journey and the same must be transmitted, he pointed out.
