The US State Department publishes the November 2024 Visa Bulletin | Morgan Lewis

US Citizenship and Immigration Services (USCIS) will use the Employment-Based Adjustment of Status Filing Dates chart in November 2024. The Filing Dates chart does not reflects no progress.

The US State Department has published some November visa bulletin setting forth the country-by-country priority cut-off dates governing the availability of immigrant visas and the flow of adjustment of status application and consular immigrant visa application applications and approvals.

WHAT DOES THE NOVEMBER 2024 VISA BULLETIN SAY?

The bulletin includes both a chart of dates for the submission of visa applications and a chart of dates for final action on the application. The first indicates when prospective immigrants can submit their applications for adjustment of status or immigrant visas, and the second indicates when applications for adjustment of status or immigrant visas can be approved and grant permanent residence.

Each month USCIS chooses which chart to follow. By November 2024, USCIS will follow the Presentation dates chart for employment-based (EB) submissions for adjustment of status. This means that individuals who wish to file adjustment of status applications with USCIS in November 2024 must use the Presentation dates chart below.

DATES FOR SUBMISSION CUT-OFF DATES

In order to file an EB adjustment application in November 2024, a foreign national must have a priority date prior to the date listed below for their preference category and country. Listing “C” indicates that the category is current and applications may be submitted regardless of the applicant’s priority date. The listing of a date for any category indicates that only applicants with a priority date prior to the date listed may submit their applications.

FIRST PREFERENCE BASED ON EMPLOYMENT (EB-1)

The EB-1 cutoff date for all payment areas, Mexico, and the Philippines will remain in effect. This means that all chargeable applicants in these areas whose I-485 petitions have not yet been filed may file their I-485 petitions with USCIS.

The EB-1 deadline for China will remain at January 1, 2023. This means that EB-1 applicants from China whose I-485 petitions are still have not filed and have a priority date before January 1, 2023 can file their I-485 applications with USCIS.

The EB-1 deadline for India will remain at April 15, 2022. This means that EB-1 applicants from India whose I-485 applications are still have not filed and have a priority date before April 15, 2022 may file their I-485 petitions. with the USCIS.

SECOND PREFERENCE BASED ON OCCUPATION (EB-2)

The EB-2 deadline for all taxability areas, Mexico, and the Philippines will remain on August 1, 2023. This means that all applicants charging these areas whose I-485 petitions have not yet been filed and have an earlier priority date. On August 1, 2023, they can file their I-485 petitions with USCIS.

The EB-2 deadline for China will remain at October 1, 2020. This means that China EB-2 applicants whose I-485 petitions have not yet been filed and have a priority date before October 1, 2020 can file their I-485 petitions with USCIS.

The EB-2 deadline for India will remain at January 1, 2013. This means that Indian EB-2 applicants whose I-485 petitions have not yet been filed and have a priority date before January 1, 2013 can file their I-485 petitions. with the USCIS.

THIRD PREFERENCE BASED ON OCCUPATION (EB-3)

The EB-3 deadline for all taxability areas, Mexico, and the Philippines will remain at March 1, 2023. This means that all applicants with charges in these areas whose I- 485 of which have not yet been filed and have an earlier priority date. On March 1, 2023, they can file their I-485 petitions with USCIS.

The EB-3 deadline for China will remain at November 15, 2020. This means that China EB-3 applicants whose I-485 petitions have not yet been filed and have a priority date before November 15, 2020 can file their I-485 petitions. with the USCIS.

The EB-3 deadline for India will remain at June 8, 2013. This means that EB-3 applicants from India whose I-485 applications have not yet have filed and have a priority date before June 8, 2013 can file their I-485 petitions. with the USCIS.

OTHER WORKERS

The deadline for other workers for all pay areas, Mexico and the Philippines will remain May 22, 2021. This means that applicants for other workers in these areas applications I -485 who have not yet filed and have a priority date before May 22, 2021 can file their I-485 petitions with USCIS.

The other worker deadline for China will remain at January 1, 2018. This means that other worker applicants from China whose I-485 petitions have not yet been filed and have a priority date before January 1, 2018 can file their I-485 petitions with USCIS.

The other worker deadline for India will remain at June 8, 2013. This means that applicants for other workers from India whose I-485 petitions have not yet been filed and have a priority date before June 8, 2013 can file their I-485 petitions with USCIS.

SIGNIFICANT DEVELOPMENTS

The November 2024 Visa Bulletin submission date chart shows no progress. USCIS will continue to use the filing date chart through fiscal year 2025 whenever it determines that there are more immigrant visas available for a fiscal year than known applicants for those visas.
