Machakos man accused of publishing false information about Governor Wavinya Ndeti

Nduli appeared before Chief Magistrate Barbara Ojoo at the Mavoko Courts on Monday, November 4, where he was formally charged under Section 23 of Act no. 5 of 2018 on Computer Misuse and Cyber ​​Crimes.

According to the indictment, Nduli published statements intended to incite panic, chaos or violence among Kenyans.

Nduli, allegedly in collaboration with others, allegedly spread unverified claims about the county boss and her son on social media.

How Nduli pleaded in his case

When the charges were read, Nduli pleaded not guilty and was later granted KSh 200,000 cash bail or an alternative bond of KSh 300,000 with surety.

His lawyer has requested access to the statements and any documentary evidence the prosecution will use in the case.

Chief Magistrate Ojoo confirmed that Nduli was informed of the charges in a language he understood and maintained his not guilty plea.

“The substance of the charge and every element thereof was stated by the court to the accused in the language he understood, who being asked whether he admitted or denied the truth of the charge, he said it was not true.” Chief Magistrate Ojoo said in his ruling

Nduli was arraigned following his arrest on October 31 by Directorate of Criminal Investigations (DCI) officers from the Athi River Police Station.

Ndeti, along with her eldest son, Charles Oduwole, are expected to be among the key witnesses in the case. The court scheduled the mention of the case for Monday, November 18.

Nyahururu man in court

Elsewhere, on July 3, an anti-government protester in Nyahururu, identified as Robert Maina Ndungu, was charged at the Nyahururu Courts.

Ndungu faced charges of incitement to violence and disobedience to the law under Section 96 of the Penal Code.

Police charged Ndungu and others shouted anti-President William Ruto chants outside the court to disturb the peace.

The charge sheet stated that Ndungu’s actions on June 25, 2024 were considered prejudicial to public peace, order and tranquility.
