Repeat Schenectady DWI Offender Faces Decades in Prison | News

In one of the cases, the man ran over a motorcyclist and drove home, prosecutors said. The motorcyclist suffered broken ribs and other injuries.

Daniel Miller, 65, of Schenectady, was convicted Thursday after trial in connection with the three incidents, one in 2022 and two in 2023.

The two DWI convictions mark his 8th and 9th convictions for that crime, officials said, his first in Schenectady County. He has other beliefs.

His criminal history means he faces a possible conviction as a persistent offender. If granted that status, he faces up to 25 years to life in prison on each felony drunken driving charge, prosecutors said.

Otherwise, they would face up to 2 1/3 to 7 years for each.

“He obviously couldn’t care less about the law and society and is a clear and present danger to anyone unfortunate enough to cross his path,” Schenectady County District Attorney Robert Carney said in a statement.

In the first incident, Miller went to Stewart’s Shop on Mariaville Road in Rotterdam on October 20, 2022 and crashed his truck into a gas pump, causing almost $1,200 in damage. He then entered the store, bought alcohol and cigarettes and left, without notifying anyone of the damage, officials said.

Then, on April 21, 2023, he drove to his home while intoxicated and ran over the motorcyclist. Miller turned left in front of the victim, who responded by throwing his bike to avoid a head-on crash, officials said.

The motorcyclist skidded and Miller drove right over the chest, officials said. Miller then drove about 50 yards to his residence in his driveway and went inside, officials said.

Others reported the accident and treated the victim, officials said. Miller was arrested and charged.

Finally, on July 13, 2023, Miller left a bar while intoxicated and was pulled over on a vehicle and traffic ticket. He was again charged with drunken driving.

At trial, Miller claimed that he was not intoxicated but suffered from self-diagnosed medical conditions.

In addition to his previous DWI convictions, Miller also has one for aggravated assault. He was also sent to prison six times. He has a total of nine felony convictions and 36 misdemeanor convictions, prosecutors said.

“In her trial presentation, ADA (Mariena) Mareno did an excellent job of proving Mr. Miller guilty of every charge he faced without the jury knowing about his career in crime,” Carney said in his statement. “But now that we can talk about it, we’re going to ask Judge (Matthew) Sypniewski to sentence Mr. Miller for his behavior here and his life of crime to life behind bars.”

The case was prosecuted by Assistant District Attorneys Mareno and Nicolaus McDonald, with assistance from District Attorney Investigator Ryan Maloney and the New York State Police. Attorney Kyle Davis represented Miller.
