Court vacates plea deal for Jupiter man who threatened Trump and Vance on social media

JUPITER – The court canceled a preliminary trial agreement in order to Jupiter man who called out social media for the crimes of former President Donald Trump and his running mate, US Senator JD Vance of Ohio.

After Circuit Judge Cymonie Rowe signed the agreement, the State’s Attorney’s Office said Michael M. Wiseman faced a felony charge too serious to qualify for pretrial intervention.

Wiseman faces a charge of making a written threat to kill, a second-degree felony that carries a maximum sentence of 15 years in prison. Only people charged with misdemeanors or third-degree felonies are eligible for probation, court records show.

The 68-year-old admitted to making social media posts promoting violence against Trump and Vance. The pre-trial agreement included conditions that he had to abide by for the next 18 months. If he had filled them out, his charge would have been dropped, court records show.

Tama Beth Kudman, Wiseman’s attorney, said she would “continue to dialogue with the state to reach the appropriate final conclusion of this matter” after Rowe revoked her client’s pretrial agreement, which the judge approved on Sept. 17 .

“I would emphasize that no one believes that Mr. Wiseman is a threat to anyone, and the original deferred prosecution agreement reflects that,” Tama Beth Kudman, Wiseman’s attorney, wrote in a statement. “Unfortunately, it was the wrong mechanism to get to the right result.”

Although Wiseman is no longer in a pretrial intervention program, his prior conditions are the same and he is not on house arrest, said Marc Freeman, a spokesman for the State’s Attorney’s Office.

Wiseman is on “level two supervised probation,” which requires him to report to a probation officer monthly.

Wiseman is not allowed to access or post on social media, possess firearms, consume alcohol, drugs or non-prescribed medication, or contact Trump or Vance. He will continue to receive care from a psychiatrist and follow the recommended treatment.

It is not known if Wiseman’s case will result in a felony conviction. Rowe’s next hearing is scheduled for Nov. 19.

A Jupiter man was arrested in July for threatening Trump, Vance on social media

Jupiter police said they received several calls about threats Wiseman had posted on July 17 and 18 on Facebook and Threads. The first came four days after an assassination attempt on Trump during a rally near Pittsburgh.

July 17 was also the day Vance accepted the GOP vice presidential nomination on the ticket with Trump.

Police arrested Wiseman without incident on July 19 outside his home, when they said Wiseman was aware of the problem with the threatening posts and “was open about it.”
