Cyber ​​security firm sued by executive claims he resigned by mutual consent – The Irish Times

A cyber security training company claims one of its directors resigned by mutual consent and told several colleagues about it, the High Court heard.

Metacompliance Ireland Ltd is being sued by Mairead Cosgrave, its senior vice-president of products and operations, who claims her alleged termination breached due process and natural and constitutional justice.

Last Friday she was granted an interim injunction preventing her dismissal pending a further order following an ex parte, or part only, application by her lawyers.

When the case came back before the court on Thursday, Padraic Lyons SC, for Metacompliance, said his side had sought an early hearing on the ban matter because the effect of Friday’s interim order was that his client was prevented from employing her or to stand in for Mrs. Cosgrave pending further orders. .

This was, he said, in circumstances where his client says Ms Cosgrave “resigned by mutual consent”. There is a significant dispute and the matter of the order will have to be heard soon, he said.

Mr Lyons also said his side had sworn a series of affidavits focusing on the central issue that her employment was by mutual consent and that she had “told a number of colleagues”.

Cliona Kimber SC, for Ms Cosgrave, said her client needed time to respond to the defendants’ affidavits.

Following a brief adjournment, Mr Justice Mark Sanfey was told the parties had agreed a timetable for exchanging affidavits. The judge said the matter could return for hearing at the end of November.
