ED opposes registrar's plea in Khadse case, family

Bombay: Opposing the application for discharge of the Deputy Registrar Ravindra Muley in a money laundering In this case, the Enforcement Directorate (ED) recently submitted that it was knowingly involved in the assistance and collaboration of the former Minister of Finance Eknath Khadsehis wife Mandakini Khadse and son-in-law Girish Chaudhari in concealment, possession and acquisition of proceeds of crime.
The ED stated that Muley was involved in the conspiracy of illegal purchase of MIDC land by Chaudhari and Mandakini at a price of Rs 3.75 crore, which was much less than the actual value of Rs 23.8 crore of rupees “In such cases, it is not necessary for the accused to have obtained or obtained the proceeds of crime. The mere provision of knowing assistance to other accused persons in any process or activity will constitute an offense of money laundering,” said the ED to your reply. Khadse, Mandakini and Chaudhari are accused of land grabbing, causing a loss of Rs 761.25 crore to the government by fraudulently signing a sale deed.
The ED alleged that Chaudhari, with the connivance of others, knowingly signed a sale deed to get compensation higher than the actual value of the land. It was further alleged that Khadse misused his authority when he was part of the BJP-Sena cabinet to buy the three-acre plot in Bhosari, Pune district, which belonged to the MIDC, in the name of of Mandakini and Chaudhari.
Opposing Muley’s petition, the ED said he misused his official position as sub-registrar while registering the land sale deed. “At the time of registration, he knew the real value of the land. However, despite having this knowledge, he did not take any steps to safeguard the rights of the government, ie MIDC, and further suppressed the value real of the land i.e. Rs.22.83 crores in connivance with Girish Chaudhari and Mandakini Khadse while registering the said sale deed on the deal value of Rs.3.75 crores of the land” , said the answer.
Claiming that the charge is nothing more than the result of a political vendetta where he has been made a scapegoat, Khadse also filed a petition for dismissal. “The applicant submits that there is not even a prima facie case made out in the complaint that the provisions of PMLA can be attracted. The respondent (Executive Director) has failed to make out a case of dishonest intention or fraudulent transaction,” the plea said. The dismissal petition said there was no abuse of power as the transaction that took place could have been made even by a person who held no public office or had any influence, political or otherwise.
